The Kyle Rittenhouse Story | Not Murder But Self Defense

Word of warning from the start. This article deals with some Graphic Content when we get to the video section and you are hereby warned of such content.


The actions of Kyle Rittenhouse on the night of 08/25/2020, while it was not necessary for him to be in Wisconsin at the place of the after hours protest / riots that night, were in fact in line with the rules for self defense law.
I am going to provide four unique perspectives for your perusal and you can then decide for yourself what the proper conclusion should be.

First things first, let get in to some official detail of this story:

In a statement released Friday, the National Foundation for Gun Rights called Rittenhouse a “law-abiding” teenager who had a right to defend himself.

Executive Director Dudley Brown told The Chicago Tribune the organization has not spoken with Rittenhouse’s family and has not had any direct conversations with his lawyers, but it decided to get involved because it wanted to take a stand against the “chaos” happening in cities across the country. Brown acknowledged Rittenhouse’s case “isn’t perfect,” but he said the defendant has a strong self-defense claim because, he believes, the people Rittenhouse shot pursued him first.

“I don’t think there are many people in America who wouldn’t have felt threatened if you were in that spot with Kyle there,” Brown said.

He would not say whether Rittenhouse should have inserted himself in Kenosha’s unrest in the first place. He said from the video he has watched, Rittenhouse knew how to handle a gun and was with adults.

“Whenever we look at cases and decide whether we’re going to jump in, of course we like them to be patently, obviously free of legal problems,” Brown said. “But that’s rarely the case, especially when you’re talking about constitutional rights.”

Records show Rittenhouse has worked as a YMCA lifeguard. His social media postings show that he idolizes police and has participated in programs for aspiring cops.

Numerous video clips posted online appear to show Rittenhouse at the scene Tuesday night with a rifle, including several that show shootings and their aftermaths. The videos also indicated that he approached police before the shootings despite being out past curfew and a year too young to carry a gun openly in Wisconsin.

Those videos, along with interviews by Kenosha detectives, are the backbone of the complaint against him.

Rittenhouse came to the demonstrations with a Smith & Wesson AR-15-style .223-caliber rifle with a 30-round magazine, the charges allege.

Video showed Rittenhouse running across the parking lot of an auto dealer where cars had previously been burned, trailed by Joseph Rosenbaum, 36, of Kenosha, prosecutors wrote. Behind Rosenbaum was Richard McGinniss, a videographer at The Daily Caller, a conservative website.

Video showed Rosenbaum seemingly throwing something at Rittenhouse, and investigators later determined it was a plastic bag, prosecutors wrote. Rittenhouse was not hit. Prosecutors wrote that McGinniss told police that “as the defendant was walking, Rosenbaum was trying to get closer to the defendant. When Rosenbaum advanced, the defendant did a ‘juke’ move and started running.”

Rosenbaum appeared to have been unarmed, prosecutors wrote.

Prosecutors wrote that as Rosenbaum and Rittenhouse approached a black car, a loud bang was heard and a male shouted and swore at him. As the men were close to one another, four loud bangs sounded and Rosenbaum fell, prosecutors said. McGinniss told police Rosenbaum had tried to grab the gun, prosecutors wrote.

Rittenhouse approached Rosenbaum on the ground, and McGinniss took off his shirt and tried to give the wounded man aid, prosecutors wrote. Rittenhouse got on his cellphone, made a call, and audio from one of the videos caught him saying, “I just killed somebody,” the complaint alleges. Investigators learned that call was to a friend, prosecutors wrote.

An autopsy showed Rosenbaum had gunshot wounds to the groin, back, hand and thigh, as well as a graze wound to the forehead, prosecutors wrote. The charge of first-degree reckless homicide stems from that shooting. Rittenhouse is charged with recklessly endangering McGinniss’ safety.

Video shows that after that shooting, Rittenhouse ran north on Sheridan Road with people in pursuit, with some yelling things such as, “Hey, he shot him!” and “Get that dude!” Someone swung at him and knocked his hat off before he tripped and fell to the ground, prosecutors wrote.

An unidentified male jumped at Rittenhouse, and he fired at him from the ground, apparently missing, prosecutors alleged.

A man carrying a skateboard and later identified as Anthony Huber, 26, of Silver Lake, then approached Rittenhouse as he was still on his back, prosecutors wrote. Huber reached for the gun as the skateboard hit Rittenhouse’s shoulder before the alleged gunman fired one shot, and Huber staggered away and collapsed, prosecutors alleged.

An autopsy showed the bullet hit Huber’s heart and one of his lungs, prosecutors wrote. Huber’s death is the source of the murder charge.

As Rittenhouse was on the ground, a man identified as Gaige Grosskreutz of West Allis approached, prosecutors wrote. After Rittenhouse shot Huber, Grosskreutz ducked, stepped back and put his hands in the air, the complaint alleges. He then moved toward Rittenhouse, who shot him in the arm, prosecutors wrote. Grosskreutz walked off screaming for a medic, they wrote.

Grosskreutz appeared to be holding a handgun when he was shot, prosecutors wrote. Wisconsin court records do not indicate that Grosskreutz has been charged with any crime. His shooting is the source of the attempted murder charge against Rittenhouse.

The gun charge Rittenhouse faces is a misdemeanor.

Now before we get in to the video evidence, let’s take a look at the backgrounds of the four attackers who violently assaulted Kyle Rittenhouse:
First there is “Joseph Rosenbaum” – According to an article on National File:

One of the men police say was fatally shot by a 17-year-old boy brandishing a rifle during the Kenosha, Wisconsin, riots was recently revealed as a convicted pedophile.

Joseph Rosenbaum, also known as “Jojo,” 36, was allegedly shot in the head by Kyle Rittenhouse in a shooting that was caught on camera from multiple after an argument emerged when the teenager traveled about 10 miles to Kenosha to protect local businesses from looting and to provide medical aid to those who needed it.

Rosenbaum, a father of a two-year-old girl, according to USA News Posts, was one of three gunshot victims–two of which were fatal–in the incident.

Internet sleuths later revealed that Rosenbaum was a convicted pedophile (link has already been “scrubbed” from the net – Here is an archived link and here it is in PDF format in case the archive is scrubbed as well) after a conviction for sexual conduct with a minor from December 2002 came to light as the pasts of those involved were dredged up following the ensuing chaos to find control over the narrative.

Anthony Huber, the man police say was shot by Kyle Rittenhouse after he attacked him with a skateboard during the Kenosha, Wisconsin riots, is has two separate convictions that stem from domestic violence charges, and served prison time for his offenses.

Video suggests Huber was the man who attacked Rittenhouse with a skateboard as the alleged shooter attempted to flee the scene after shooting another man, convicted pedophile Joseph Rosenbaum. As Rittenhouse ran toward police vehicles approaching the scene, Rosenbaum and others appear to have tackled Rittenhouse. One man attacked him with a skateboard, while another man had a pistol.

Huber was arrested in 2012 for charges including domestic violence, “Use of Dangerous Weapon,” “Strangulation & Suffocation,” “False Imprisonment,” and battery. He was ultimately convicted of strangling and falsely imprisoning a person.

Huber was sentenced to two years in prison, and was credited for 352 days served during his case. He was released from probation for this conviction in May of 2020.

Then, in 2018, after Huber was released from prison but still on probation for his 2012 conviction, he was arrested for domestic abuse, disorderly conduct, and battery. He was ultimately convicted and sentenced to probation.

Huber was also caught in possession of drug paraphernalia, which is not a criminal offense in the state of Wisconsin, in 2015.

While GoFundMe banned a campaign raising money for Rittenhouse, but recently promoted Huber’s campaign on its official corporate Twitter account.

Finally we come to the fourth and final attacker involved in the shooting incident who is known as “Gaige Paul Grosskreutz” and according to yet another article by National File:

In 2013, Gaige Paul Grosskreutz, who suffered a brutal arm injury after Kyle Rittenhouse allegedly shot him, was arrested and charged with felony burglary, theft, criminal trespass, and disorderly conduct. It is unclear whether he was convicted of a felony.

He was arrested again in 2017. And, in 2019, he pleaded no contest to a Non-Traffic Ordinance Violation. Grosskreutz is a member of the fringe radical movement the People’s Revolution Movement of Milwaukee which was called a “social justice reform group” by the Milwaukee Journal Sentinel.

Gaige Paul Grosskreutz, the anarchist who was shot in the arm is a felon, and not allowed by law to be in possession of a firearm.

Video appears to show Grosskreutz holding a pistol even after he was allegedly shot by Rittenhouse. National File reported:

Instagram user LourieAlex notes that “Shootings occurred tonight during protests in Kenosha, Wisconsin. This injured victim was treated by civilian volunteers before the police intervened.”

Specifically, LourieAlex notes “The injured man was also armed at the time he was shot. The man was not shot by law enforcement.” The man is seen in the second photo of the Instagram post with his arm severely wounded, still holding a pistol.

What you are about to see in the first video below is the “Social Media” version which created the main stream media feeding frenzy over whether or not he, Kyle Rittenhouse, is a criminal or not.

Before anyone even had the chance to provide a forensic analysis they have him tried and convicted in the mind of the public of 1st degree murder. This is approximately what was shared on social media before it was taken down by the communist censors. This version of the scene came out as basically just raw video and no accompanying analysis.

Kyle Rittenhouse – Let’s talk facts in the Kenosha Wisconsin shooting from a Lawyer’s standpoint:
A lot of people are saying that Kyle Rittenhouse went to Kenosha looking for trouble, he was a vigilante, he was trying to play cop… However, some are saying he was just there to help protect property and protesters so let’s hear why he said he was there. (shown in video)
A lot of people feel some type of way about Kyle bringing an AR-15 with him to a protest/riot and I get it, why bring a rifle to a peaceful protest? Well sometimes protest turn into riots and an AR-15 is one of the most effective self-defense tools in the world. That’s why it’s the most popular rifle in the country.
I know seeing someone carrying an AR makes some people uncomfortable, but I also can’t blame someone for wanting the best means of protection when they’re going into what could turn out to be a dangerous and volatile situation. Also, let’s be clear, there were a lot of protestors and rioters with guns at this protest/riot.
However, there is the issue of legality. Kyle is 17 and In Wisconsin, any person under 18 years of age who possesses or goes armed with a dangerous weapon is guilty of a Class A misdemeanor.
So, on the surface, Kyle was carrying his rifle illegally, but Wisconsin law has an exception that says that law only applies if the person has a short-barreled rifle or shotgun or the person does not have a certificate of accomplishment to obtain hunting approval.
Kyle may or may not have this, I don’t know and this exception may only apply in cases of hunting, it’s not very clear, but my gut tells me, Wisconsin wasn’t trying to carve out an exception that let minors open carry during a protest/riot and the exception was more about hunting.
Then there are people saying Kyle shouldn’t have been there because there was an 8pm curfew and they’d be right, but that also means the protestors and rioters shouldn’t have been there either.
I’m not really a fan of any 17-year-old being at a protest/riot. I know 40-year-olds who don’t have the mental maturity to deal with the dynamic of a riot much less an impressionable 17-year-old, but if we send 18-year-olds to fight people in other countries, so then can I really say anything to a 17-year-old who wants to help protect business and people in his country.
There are a lot of people making a big deal about the fact that Kyle drove in from Antioch Illinois.
The drive from Antioch to Kenosha is 30 min. That’s shorter than a lot of people’s daily commute. Anthony Huber the kid with the skateboard who was shot and killed, lived in Silver Lake, that’s a 30 min drive to Kenosha. Gaige Grosskreutz, lived in West Allis, WI and that’s a 49 min drive to Kenosha. So, it’s safe to say they all should have probably stayed home that day, but none of them did so here we are.
In Wisconsin, Deadly force can only be used if a person reasonably believes that such force is required to avoid death or great bodily harm.
There is no duty to retreat unless you were the initial aggressor. If you are the initial aggressor, you can only use deadly force if you reasonably believe all means to escape great bodily injury or death has been exhausted.

Yes, the people attacking Kyle think he just murdered someone, but they are attacking him. They are not defending themselves from him to prevent death or great bodily injury, so under the letter of the law, they are the aggressor at that moment. Because they have a disparity of force (ie way more people than him) and weapons or objects being used as weapons, Kyle is legally justified to use deadly force to stop them.
So as a lawyer, unless some new info comes out that shows Kyle was the initial aggressor and he had a way to retreat, legally I don’t think he will be charged with murder.
Yes, Kyle probably broke the law in that he was a minor open carrying a firearm. However, Kyle breaking that law does not mean he forfeits his right to self-defense if it is justified.
This is similar to a situation in which I’m a felon and I have a gun that I use to protect myself during a home invasion.
I’m still going to jail, but not for murder. It’ll be for me having a gun as a felon because my use of deadly force with that gun even though it was illegal for me to have, was justified.
In this case from the looks of the information up to this point, legally, he was justified.
Because of this, I think Kyle is going to plead to the lesser charge of open carrying a firearm as a minor, but I don’t see him getting convicted of murder.
