U.S. Supreme Court: You Do NOT Need To Obey Un-Constitutional Laws

Washington DC,

Admidst all the seeming confusion going around about whether the “COVID-19 Mask Mandates” are constitutional or even enforceable as law, I felt the need to write a bit on this topic in order to help clear up any confusion people might have regarding unfair and unjust laws that seek to limit one’s rights and freedoms. Specifically I am addressing the constitutionality of the current ALLEGED laws regarding “Stay-At-Home Orders”, “Social Distancing”, and the “COVID-19” Mask mandates.

If we have a look at the US Constitution we can find in there that government Shall Make No Law that infringes on the reasonable rights of the individual citizen. If you know your constitution then you would know I am referring to the “Bill of Rights” and more specifically, the 1st Amendment of the US Constitution, the Very First Amendment of the “Bill of Rights” which reads as follows:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

 ~ 1st Amendment ~

So when we have a look at the so called “Stay-At-Home Orders”, “Social Distancing”, and the COVID-19 “Mask Mandates” being dished out by Governors around the country (United States of America) it isn’t that hard to understand that these “Executive Orders” (Rule by Fiat) are really nothing more than illegal and unlawful “Royal Edicts” being declared by corrupt and criminally minded men and women in offices of our government, by which they are actually being used to USURP our Constitutional Rights and Liberties as Free Men and Women of the United States of America; Dare I say, even the rights of those in other countries who are granted and hold similar humanitarian rights under their own specific constitutions and UN Human Rights Declarations alike.

As far back as I can remember, It has been long held that mankind was granted certain inalienable rights by God, the Creator of all things, man and the universe alike. Call him what you will, “Source”, “Entity”, “Big Man in the Sky”, however you slice it, God is the Author of ALL CREATION and NO man is above his Creator…

So I set out to find some very prudent and sage advice from others around the net and see if there are others out there who believe in the same fundamental human rights as I and many others do. You know what? It did not take long to find them. As it turns out there are a great Many people out there researching and writing about this very same topic. Specifically I have chosen two sources and in those two sources I have found just about every point I wanted to make on this topic. Let’s have a look shall we?

First we come to an article from a great site called Run Your Own Country: Author’s Name: Patriot

With the increasing distance between the patriot movement (those who adhere to the Constitution) and both liberal and conservative elements in government who seem increasingly inclined to make it up as they go along, a question grows in the minds of many Americans:

Good People Disobey Bad Laws“Must I obey un-Constitutional laws?”

The short answer is “No.” To understand why this is true, however, we need to examine both the history and current status of U.S. law.

The greatest threat America faces on a day to day basis are those who masquerade as protectors and defenders of the American people.
D.C. has long since ceased to be of any value to the public although corporations and the obscenely rich find a home away from home in this ten square mile district.

We are also standing on the edge of a precipice and if we don’t stand up and collectively demand a return to, and an affirmation of, who we are and what has bound us together for more than 200 years, we will be driven over the edge into an unimaginable abyss.

As congress continues its daily deluge of anti-American legislation, its un-American activities, bear in mind that just because congress said it, doesn’t make it so.

Since an unconstitutional law is void, the general principals follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it . . .

16 Am Jur 2d, Sec 177 late 2d, Sec 256

Consider this opinion of the Supreme Court:

The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The Constitution of the United States is the supreme law of the land, and any statute, to be valid, must be in agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail.

This is succinctly stated as follows:
The general rule is that an unconstitutional statute, though having the form and name of law, is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed.
Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.
Since an unconstitutional law is void, the general principals follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it . . .

An unconstitutional law cannot operate to supersede any existing valid law.
Indeed, insofar as a statute runs counter to the fundamental law of the land, it is superseded thereby.
No one is bound to obey an unconstitutional law and no courts are bound to enforce it.

John Cinque - Branford CT 16 Am Jur 2d, Sec 177 late 2d, Sec 256
Keep this in mind when your friends and family, or your elected officials tell you that “it’s the law, you have to.”

If that law is arbitrary to the constitution, if it renders you subject to illegal or unconstitutional laws and acts it is in fact, null and void.

From the 16th American Jurisprudence, Second Edition, Section 177: “The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statute, to be valid, must be in agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. It is the duty of every lawful American Citizen to oppose all enemies of this Nation, foreign and DOMESTIC.

 — from-the-16th-american-jurisprudence

Keep this in mind when the courts rule in favor of corporate interests knowingly violating the rights and protections afforded the people as described in the Constitution.
Almost without exception, every law that has been passed by one administration and congress after another in the last twenty years has substantially violated and reduced the rights of Americans.

One of the gravest mistakes made by Americans today is the mistake of assuming that because congress passed a piece of legislation and the president signed it, the violations of rights and liberties, the assaults on the American people under the guise of [national security] or other created crisis are justified or legal.

You have guaranteed rights only so long as you defend them from encroachment by the government.

OP-ED by: Marti Oakley, Contributing Writer to Run Your Own Country

So if someone tells you that you should “Blindly Obey” every mandate and “Royal Edict” that comes out of the mouths of crooked politicians (they are not all crooked but these days a great many are), then you should let them know there are still Constitutional laws in this country that still uphold our God Given, Constitutional Rights and there are still good Judges that will protect and enforce those laws to protect our rights.

And let me further assure you that the same thing just happened in Pennsylvania as as well where A Federal Judge just ruled Pennsylvania Gov. Tom Wolf and Dr. Rachel Levine’s Shutdown Orders as Unconstitutional. The ruling states the congregate restrictions and stay-at-home orders are unconstitutional. We have Carlisle Pennsylvania Senator Doug Mastriano and his team of fellow patriots to thank for this win in Pennsylvania.

This  now sets a precedent that can be used by other states to begin to make headway in the fight to recover our stolen rights back from these unconstitutional, criminal thugs in the halls of government acting under the guise of our “protectors” while they secretly plot and scheme to rob us all of our Constitutional Rights and Liberties.

ROMANS 13:

Every statist’s favorite go-to proof text to use out of context in an attempt to justify their support of evil politicians and their own blind submission to a criminal, corrupt, and oppressive government and their idolatry of those who enforce that government’s unjust, immoral, unethical, and tyrannical edicts

Next we will have a look at what most people misunderstand about Romans 13 and how it us often used by tyrants to quell dissent and coerce law abiding citizens in to blind obedience, this being because most people, even declared Christians, have no real clue of the meaning of this chapter because they are lazy scripture readers. They might know this chapter by heart and may even be able to quote it verbatim, but most of them have no real idea of its true meaning. This comes from a site called “craiggreenfield“. A very insightful read in my humble opinion: Author’s Name: Craig Greenfield

A Word About Romans 13:

Take Romans 13. This chapter is one of those classic clobber passages, used to make sure we are all being obedient citizens, which historically has led Christians into all KINDS of problems:

“Everyone must submit himself to the governing authorities…” (Romans 13:1)

His fellow Bible-writer, Peter, wrote something very similar:

“Submit yourselves for the Lord’s sake to every authority…” (1 Peter 2:13)

I call these clobber passages because they are too often used to crush dissent, stifle protest and discourage civil disobedience.

But we live in times where dissent is more important than ever. All around the world we are witnessing the rise of the “strongman” – brutal leaders like Putin, Erdoğan, Duterte and yes, Trump. These are hard-line men who rule with an iron fist and with little regard for justice or the downtrodden.

I’m concerned that if we don’t get this right, we could easily find ourselves treading the path of the German church under Hitler’s Nazi government.

In those days, too many good citizens – good Christians! – stood by, while their vulnerable neighbours were crushed by the governing authorities.

So, let’s take a closer look at these passages.

After Jesus’ death and resurrection, King Herod got super mad and arrested some of the believers, including James and Peter, and put them on public trial. The night before the trial, an angel of the Lord woke Peter up, removed his chains, opened the prison doors and led him out the main gate of the prison.

Yet after escaping from jail, where he had been imprisoned for breaking the law, Peter went on to write in a letter:

“Submit yourselves for the Lord’s sake to every authority instituted among men: whether to the king, as the supreme authority, or to the governors, who are sent by him to punish those who do wrong and to commend those who do right. For it is God’s will that by doing good you should silence the ignorant talk of foolish men.”

And similarly, while Paul was in Damascus, he escaped from a strongman city governor who was trying to arrest him, by concealing himself in a wicker basket and having himself lowered down the city wall through a window.

Then after reaching safety, Paul wrote a surprising letter:

“Everyone must submit himself to the governing authorities, for there is no authority except that which God has established. The authorities which exist have been established by God. Consequently, he who rebels against the authority is rebelling against what God has instituted, and those who do so will bring judgment on themselves.”

So are Peter and Paul hypocrites, asking Christians to do as they say, but not as they do?

Though these passages have been used to maintain the status quo (ever since the Emperor Constantine became a Christian and made it the official religion of the Empire), there is a BIG disconnect between Peter and Paul’s actions and the way we have traditionally interpreted their words.

The key to undertanding is in the word “submit”. Take a look at this. The Greek word hupo-tasso, which has been translated as “submit” or “be subject,” literally means to arrange stuff respectfully in an “orderly manner underneath”.

This simple meaning of “social orderliness” would have been understood by original readers, but it is a little obscured in our English translation.

This word is used in Ephesians 5:22 to encourage husbands and wives to submit to one another, and it reflects God’s concern for order and respect.

Here’s the main point – Paul and Peter believed that governing authorities are necessary for keeping the peace. God is a God of order – not anarchy or chaos.

“Historically, the most terrible things: war, genocide and slavery,
have resulted not from disobedience, but from obedience.”    – Howard Zinn

But here’s where we go wrong. There’s ANOTHER word, hupo-kouo, which is best translated as “obey,” which literally means to conform, to follow a command, or to kowtow to an authority as a subordinate.

Peter and Paul could have used this word, “obey,” but they chose not to.

Used twenty-one times in the New Testament, hupo-kouo always suggests a hierarchical context, as in the relationship between children or slaves and their parents or masters (Eph 6:1 and 6:5).

And so here’s the most important thing to remember – in the New Testament Greek, to submit does not always mean to obey! They are two separate actions or postures.

Though Paul, Peter and other followers of Jesus deliberately disobeyed laws that were in conflict with God’s commands, they still submitted to the authorities by accepting the legal consequences of their actions.

I’m proud to be friends with a bunch of clergy, activists and other serious Christian types who are willing to pursue justice in costly ways.

Some of them stage hippie sit-ins on the floor of their local government representative’s office to protest unjust treatment of refugees. Others chain themselves to bulldozers to protest environmental injustice.

I won’t mention everything online, but suffice to say, many of them are willing to break laws that are wrong and unjust.

This is nothing particularly new. As far back as the book of Exodus, the Hebrew midwives refused to carry out the Pharoah’s repugnant order to murder newborn babies.

The first people who sought to worship Jesus, a trio of spiritual gurus from Asia, deliberately disobeyed the orders of King Herod, a criminal offense punishable by death (the first recorded act of civil disobedience in the New Testament). Many of the disciples ended up in prison.

As Christians, the law cannot be our ultimate moral guide.  Slavery was lawful. The holocaust was legal. Segregation and apartheid were legally sanctioned. Many of today’s laws are created to protect corporations rather than people.

Simply put, the law does not dictate our ethics. God does.

 — No, Romans 13 is not about obeying the governing authorities

So as we have seen above and also by using just a little bit of common sense, I think we can safely deduce that it is actually in our best interests, and our children’s best interests as well, to wholeheartedly “Question Everything”, do our own due diligence in research, and make sure we exercise our right to civil disobedience. In fact, Civil Disobedience is not just our right, it is YOUR DUTY as a Free Citizen to Disobey Unjust and Un-Constitutional laws or your very children and grandchildren will pay the price for your incompetence and end up as slaves to the very same unjust laws you failed to challenge. Many men and women alike fought, bled, and died for the very freedoms most of us in this world seem to be taking for granted and that is NOT OK…

Understand that we are not entirely “out of the woods” yet on these issues. There are still the royal edicts and over reach of power we need to quell from these criminal Governors such as the likes of California Governor Gavin Newsom, Pennsylvania Governor Tom Wolf, Arizona Governor Doug Ducey, and many other Governors who are trying to make themselves “King of their regions” by usurping our Constitutional rights through the illegal issuance of Un-Constitutional, “Royal Edicts” (Rule by Fiat) that seek to remove our rights and imprison us all without due process of the law…

That is all I have for now,
